Legal principle

The claimant must first prove facts from which the tribunal could conclude, in the absence of an adequate explanation, that discrimination occurred. If that threshold is met, the respondent must provide a non-discriminatory explanation.

What the court decided

The Court of Appeal approved structured guidance for applying the statutory burden of proof while emphasising that tribunals must consider all the evidence.

The practical test

    Decide what primary facts the claimant has proved.

  2. 2

    Ask whether those facts could support an inference of discrimination without an adequate explanation.

  3. 3

    If so, assess whether the respondent has proved a non-discriminatory reason for the treatment.

How tribunals apply it

  • The tribunal may draw inferences from evasive answers, inconsistent explanations and unexplained departures from procedure.
  • The respondent's evidence can be considered when deciding what facts are proved.
  • The burden framework is an aid to deciding the reason for treatment, not a substitute for factual findings.
