Overview
Discrimination can be direct, indirect, harassment, or victimisation.
There is no minimum service requirement for discrimination claims.
Protected characteristics
- Age, disability, gender reassignment, marriage or civil partnership
- Pregnancy or maternity, race, religion or belief, sex, sexual orientation
Types of discrimination
- Direct discrimination and harassment
- Indirect discrimination through policies or practices
- Failure to make reasonable adjustments for disability
- Victimisation after raising concerns
Time limits and remedies
- Claims are usually 3 months less 1 day from the act.
- Compensation can include injury to feelings and financial loss.
- Reasonable adjustments can be required during the process.
Common questions
Can I claim if I am a worker not an employee?
Yes, discrimination protections apply to workers as well.
Do I need a comparator?
Not always, but comparing treatment can strengthen a claim.
Can I bring a claim while still employed?
Yes, you can bring a claim without resigning.
