Prompt Resignation

Overview

In constructive dismissal, you must resign in response to the breach. If you delay without good reason, tribunals may decide you 'affirmed' (accepted) the breach.

What you can do

  • If you are attempting to resolve the issue (e.g., via a grievance or sick leave), clearly state in writing that you are working 'under protest'.
