Overview
In constructive dismissal, you must resign in response to the breach. If you delay without good reason, tribunals may decide you 'affirmed' (accepted) the breach.
What you can do
- If you are attempting to resolve the issue (e.g., via a grievance or sick leave), clearly state in writing that you are working 'under protest'.
