Right of Appeal
Why employers must offer an appeal against a dismissal decision.
Last updated 21 February 2026
Overview
The ACAS Code of Practice (Para 26) states that employees should be given the right of appeal against any disciplinary decision.
An appeal is a chance to rectify procedural errors made during the initial hearing.
What you can do
- If not offered, request an appeal in writing anyway.
- State clearly why you believe the original decision was wrong.
- Keep records of your employer's response (or lack thereof).
