Qualifying Service
The 2-year service rule for standard unfair dismissal claims.
Last updated 21 February 2026
Overview
In most cases, you need two years of continuous service with your employer to bring an ordinary unfair dismissal claim.
However, 'automatically unfair' reasons (like whistleblowing, pregnancy, or asserting a statutory right) do not require two years of service.
What you can do
- Check your exact start and end dates (including your statutory notice period).
- If you have less than two years, assess whether your dismissal was for an 'automatically unfair' reason or involved discrimination.
